Born in Manila on 10 December 1938 to Celedonio Benipayo and Amada Logronio, Alfredo Benipayo finished his elementary schooling at the Francisco Balagtas Elementary School. He later on went and finished both his high school and college education at the University of Santo Tomas. He obtained in the said university his Bachelor of Laws degree in 1962 and was admitted to the Philippine Bar the next year.

He started his law practice as an associate attorney in the Jose W. Diokno Law Office and was a senior partner in the Reyes and Benipayo Law Office. He was appointed district judge of the CFI of Malolos, Bulacan in1964; district judge of the CFI of Manila in 1976; and associate justice of the court of appeals in 1987. he held the office of the Court Administrator of the Supreme Court from October 30, 1996 to February 15, 2001 when he was appointed as chairman of the Commission on Elections. He served as Solicitor General from October, 2006 to March, 2007.

Alfredo Benipayo is married to Rowena Hizon Castro with whom he has five children.
